Wrongful Death

If a loved one has died as a result of someone else’s negligence, a defective product, medical malpractice, or in an accident, you may be entitled to recover for your loss in a wrongful death claim.  Your loved one’s estate may be able to recover the following damages and expenses in a wrongful death claim:

  • Pain and suffering the deceased suffered before death, if the decedent was conscious of it
  • All medical and funeral expenses
  • Lost wages and benefits the deceased provided to his or her family
  • Loss of support, companionship, and care suffered by close survivors
  • In some cases, the court or jury will award punitive damages; the goal of punitive damages is deter the wrongdoers from causing the same kind of harm again.

Connecticut’s statutes involving wrongful death allow a deceased’s executor, spouse, children, and parents to file a wrongful death claim.  Additionally, the law generally imposes a two year statute of limitations that begins upon the person’s death, during which time the wrongful death claim must be filed.  Failure to file a lawsuit before the expiration of the statute of limitations will result in the claim being barred; it is advisable to contact an experienced wrongful death attorney as soon as possible to preserve your rights.

Wrongful death cases are often particularly complex cases involving large insurance companies as the adversary.  Your attorney must understand how these insurance companies evaluate claims and must have the knowledge, experience and advocacy skills to successfully challenge a much larger adversary in settlement negotiations and, if necessary, at trial.  The attorneys at Kenny, Brimmer & Mahoney, LLC have extensive experience handling wrongful death cases caused by a variety of factors, including medical malpractice, products liability, automobile accidents, by a homicide or manslaughter, and in the course of employment.

We also appreciate the devastating affects that the sudden death of a loved one can have on his or her survivors.  We are dedicated to providing a personalized and approachable team so you feel comfortable with us representing you and your family.  If you have experienced the loss of a loved one due to another person’s negligence, contact the experienced attorneys at Kenny, Brimmer & Mahoney, LLC today for a free initial consultation regarding your wrongful death claim.
